CONDITIONS OF BUSINESS FOR THE COMMISSION SALE

The sale on commission is a service of the Austrian Federal Theatres and is intended to offer customers who have already purchased tickets for the Austrian Federal Theatres but who cannot attend the performance for health reasons, for example, the opportunity to offer their tickets for resale on the Internet or in part at the Federal Theatres' box offices.

1. The Vienna State Opera and the Burgtheater accept tickets from customers for performances that have not yet taken place for sale on commission if the tickets have been purchased by the customer via the Internet (www.wiener-staatsoper.at, www.burgtheater.at, www.culturall.com) and the tickets have not yet been printed.

2. The Vienna State Opera will accept tickets for performances that have not yet taken place and also for commission-based sales, if a) the tickets have been purchased through the Vienna State Opera's ordering office and these tickets have not yet been printed out, or b) tickets of the Vienna State Opera have been purchased from the Federal Theatres and the original tickets have been handed over to the Federal Theatre box offices. Commercial resellers are excluded.

3. Culturall Handelsges.m.b.H. accepts tickets from customers for performances of the Volksoper Wien that have not yet taken place for sale on commission if the tickets have been purchased by the customer via the Internet (www.volksoper.at, www.culturall.com) and the tickets have not yet been printed.

4. Only tickets of the Vienna State Opera according to points 1 and 2 are also offered for resale at the box offices of the Federal Theatres.

5. In the following, a customer offering tickets for sale on commission, seller and a customer buying tickets sold on commission are referred to as buyers. The purchase price is the price that the seller originally paid for the ticket at the Federal Theatres, normal price is the original non-discounted purchase price printed on the buyer's ticket. Sales price is the price that the buyer has to pay for the commission card. Refund price is the amount that the seller of the card receives in case the card is sold. Surcharge is the extra amount that is charged to the buyer for the purchase of commission cards.

6. Vienna State Opera:The surcharge for the purchase of commission tickets is generally 6% of the normal price, but at least 2 Euro; however, the buyer can determine the sales price for tickets of the Vienna State Opera himself within a certain limit: The refund price may not exceed 1.2 times the purchase price at the Vienna State Opera. In this case, in addition to the 6% of the normal price, the surcharge shall be an additional 30% of the part of the purchase price that exceeds the normal price; the refund price may only be set lower than the purchase price of the ticket if there are no more tickets in the corresponding category/price group.

7. Burgtheater: The extra charge for the purchase of commission tickets is always 6% of the normal price. However, if the surcharge of 6% is less than 2 Euro, the difference is to be borne by the seller, the refund price is reduced accordingly. The reimbursement price for tickets of the Burgtheater must not be higher than the purchase price.

8 All amounts are gross amounts and include VAT.

9 The rules described above apply analogously to the commission sale of reduced tickets. These can only be sold by the seller at the purchase price plus surcharge, the sales price in turn consists of the normal price plus surcharge.

10. ART for ART Theaterservice GmbH and, on the Internet, Culturall Handelsges.m.b.H. (hereinafter CULTURALL) have been commissioned to handle the sale in the name and for the account of the stage company at the Bundestheaterkassen. CULTURALL has been commissioned with the reimbursement of the purchase price

11th CULTURALL confirms for the Federal Theatres the acceptance of the sales order to the seller by immediate visibility in the web offer. For tickets of the Vienna State Opera, which are given on commission at the box offices of the Federal Theatres, a written confirmation is given to the seller.

12. The seller is informed of the completed sale by e-mail. If the tickets have been put on commission at the box office, the seller will only be informed by e-mail if an e-mail address has been provided by the seller for this purpose.

13. The buyer makes the payment for the Federal Theatres to CULTURALL. After receipt of payment, a credit note will be issued under deduction of the surcharge for commission-based sales and the resulting amount will be transferred to the seller within 4 weeks. In the case of subscription tickets, the credit note is only transferred after the subscription has been paid in full.

14. In the event of a change/cancellation, the buyer will receive a refund of the normal price printed on the card, but not the surcharge.

15 The customer is obliged to inform us immediately of any change in his contact details. All declarations made by the Federal Theatres or Culturall to the customer are deemed to have been received if they were sent to the customer at the last known address or e-mail address and the customer has not notified a change of address or e-mail address. If the customer provides incorrect contact details or fails to notify changes without delay, the customer must bear the resulting damage or compensate for it himself.

16 The Federal Theatres are entitled to exclude customers from commission sales at any time; in particular if there is a suspicion that the commission sale is being carried out commercially by the seller.

17. All contractual relationships between the customer and the federal theatres shall be governed by Austrian substantive law, with the exception of UN sales law.

18. The business relationship between Wiener Staatsopern GmbH or Burgtheater GmbH / Culturall and the customer is exclusively governed by these terms and conditions in the version valid at the time of the order or the submission or placing of a sales order by the customer.

19. The competent court for all disputes is the Commercial Court of Vienna or, up to the amount specified in §49 (1) JN, the District Court for Commercial Matters Vienna (not applicable to consumers).

20. For technical reasons, EPS is currently not permitted as a payment method when purchasing commission cards until further notice.
